1. Agreement to Terms

MyOIA.nz is a web-based platform that helps New Zealand residents manage their Official Information Act (OIA) and Local Government Official Information and Meetings Act (LGOIMA) requests. The Service provides:

• Tools to create, submit, and track OIA/LGOIMA requests
• Email management for request correspondence
• Document storage and organization
• Templates and AI-assisted request drafting
• Integration with third-party services (for premium subscribers)

3. User Accounts

3.1 Registration

To use the Service, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Verify your email address
• Maintain the security of your account credentials

3.2 Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized use

4. Subscription Plans and Payments

4.1 Free Tier

• Up to 2 OIA requests per month
• Basic features and templates
• No AI suggestions
• No custom templates
• No NationBuilder integration
• No API access

4.2 Basic Tier ($14.99/month)

• Up to 100 OIA requests per month
• AI-powered request suggestions
• Custom templates
• Priority support
• Advanced request tracking
• No NationBuilder integration
• No API access

4.3 Premium Tier ($49.99/month)

• Up to 500 OIA requests per month
• All Basic tier features
• NationBuilder CRM integration
• Personal API keys
• Advanced analytics
• Public request sharing
• Priority support

4.4 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

4.5 Refunds

We offer a 14-day money-back guarantee for new subscriptions. After this period, fees are non-refundable except where required by law.

5. Acceptable Use

You agree not to use the Service to:

• Submit false, misleading, or frivolous OIA requests
• Harass, abuse, or harm government agencies or their staff
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malware, spam, or other harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with other users' use of the Service
• Use the Service for any illegal purpose

6. OIA Request Responsibilities

6.1 Your Requests

You are solely responsible for the content of your OIA/LGOIMA requests. We do not review requests before submission and are not liable for:

• The content or accuracy of your requests
• Responses or decisions made by government agencies
• Any consequences arising from your requests

6.2 Legal Compliance

You must ensure your requests comply with the OIA and LGOIMA requirements. This is not legal advice, and we recommend consulting with a legal professional if you have questions about your rights.

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by RB ALLIANCE LIMITED and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a license to store, process, and transmit your content as necessary to provide the Service.

8. Third-Party Services

The Service may integrate with third-party services including:

• Stripe for payment processing
• Resend for email delivery
• NationBuilder for CRM integration (premium feature)

Your use of these services is subject to their respective terms of service.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months

10. Indemnification

You agree to indemnify and hold harmless RB ALLIANCE LIMITED and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and data after a reasonable period
• Provisions that by their nature should survive will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
